**Applicable to use of reCaptcha upon signup to Voxer Site. reCaptcha Service is used on the Voxer Site. The reCaptcha Service provide images and/or audio clips (collectively, “Images”) that are useful for distinguishing between humans and computers for the purposes of preventing abuse of a website, and also harnesses the power of humans.A user of the Voxer Site agrees that reCaptcha will continue to own the image to be solved and the image solved (whether or not correct).
**Applicable to Voxer Walkie Talkie iPhone device software. Apple, Inc. (“Apple”) has certain mandatory terms which apply to persons who obtain applications to be used on Apple Devices (including iPhones, iPads, itouch, etc.) through the Apple APP Store.If you obtained any component of Product from the Apple APP Store, then the following applies:
a. Customer acknowledges that this Agreement is concluded between Customer and VoxerNet LLC and not Apple, and as between Apple and VoxerNet LLC, subject to the terms of this Agreement, VoxerNet LLC is solely responsible for the Product.
b. Customer’s use of Voxer Walkie Talkie iphone devices software must be on devices owned or controlled by Customer. Any component of the Product to be used with Apple Devices may not be used beyond the Usage Rules set forth in the App Store Terms of Service.
c. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Product.
d.If Product obtained through the Apple App Store and Product fails to conform to any applicable warranty provided to Customer (if any), Customer may notify Apple, and Apple will refund the purchase price for the Product (if any) to that Customer; and that, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Product, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be VoxerNet LLC’s sole responsibility.
e. Apple is not responsible for addressing any claims of the Customer or any third party relating to the Product or the end-user’s possession and/or use of that Product, including, but not limited to: (i) product liability claims; (ii) any claim that the Product fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
f. Customer and Voxer acknowledge that Apple is not responsible for the investigation, defense, settlement and discharge of any intellectual property infringement claim with respect to Product.
g. Customer represents that (i) he/she is not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) he/she is not listed on any U.S. Government list of prohibited or restricted parties.
h. Apple, and Apple’s subsidiaries, are third party beneficiaries of this Agreement, and that, upon the end-user’s acceptance of the terms and conditions of this Agreement Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against the Customer as a third party beneficiary thereof.
