1. Scope. This document outlines the VoxerNet LLC (and the Voxer® Affiliates, meaning any entity controlling, controlled by or under common control with Voxer®) (collectively “Voxer”) privacy policy. By using or accessing the Voxer® Site or the products provided to you by Voxer®, including Voxer® Walkie Talkie (“Products”), you agree to our privacy practices outlined here. The Products may enable access to third party (other than Voxer Affiliates) services/technologies/websites (via links available through the Products or Voxer Site) and this privacy policy does not apply to any data that may be collected or used by such third parties. You should always review the policies of third party applications and websites to make sure you are comfortable with the ways in which they use information you share with them. We have no control over third party applications and we are not responsible for the privacy practices of other sites, and we encourage you to read their privacy statements.

2. Questions; Contacting Voxer; Reporting Violations. If you have any questions or concerns or complaints about the Voxer Privacy Policy or our data collection or processing practices, or if you want to report any security violations to us please contact our privacy team at: http://voxer.com/about.

3. Integrity of your personal information. Voxer endeavors to keep any personal information we may maintain about you accurate, complete, and up to date for the purposes for which it is used. You can check your profile in the Product and correct any invalid data that appears in your profile.

4. Minors under the age of 13. Minors should not register for this site. We do not knowingly collect personal information from children under 13. If a child under 13 submits personal information to Voxer and we learn that that personal information is the information of a child under 13, we will attempt to delete the information as soon as possible. If you believe that we might have any information from a child under age 13, please contact us through this http://voxer.com/about.

5. Information We Receive or Collect.

a. Information You May Provide:

Profile Information. When you sign up to the Voxer service or update your profile information you may provide us with certain contact or personal information, such as your name, email address, phone number, your image, or other personally identifiable information about you. This data will be stored on your device and on our servers for a period of time.

Communication Content. One of the primary reasons people use the Products is to communicate with others. Voice, text and pictures that you create to communicate with your Contacts and colleagues will be stored on your device and on our servers for a period of time.

b. Information We Collect During Your Use of Voxer Site or Use the Products:

Information and Data Collected During Normal Use of the Products. In order to perform to its specifications, the Products will regularly communicate with Voxer hardware/software/servers during the normal course of operation and such hardware/software/servers will retrieve, process, transmit and store data and content from the Products and the devices which the Products are loaded onto (including voice conversations and text conversations). In addition, the Products may automatically send us crash reports from your device. We use this information to diagnose problems with the Products and to improve them.

Contacts Information. As part of your usage of our Products, we provide you the opportunity to connect automatically with your friends. We employ various techniques in order to facilitate friends finding each other on our service, including offering contact importer tools to facilitate adding to your contacts (including Facebook Friends and contacts in your address book) so that you can more readily ask your contacts to join and communicate with you through the Voxer Products. With your permission, we will access your address book, call log and SMS log, and import your contacts’ names, email addresses, phone numbers, image, geographic location and Facebook IDs to facilitate automatic connection with your friends. We do this only for contact matching to help your friends and you find each other. Also, when you invite friends to the service, we will access your Address Book and we will import your contacts names and phone numbers in order to facilitate the invitation. We also collect some settings that help us to interpret your data, such as the language and keyboard settings that you have established, and the phone’s carrier, mobile network code and mobile country code.

Location Information. If you have enabled location services on your phone, we collect your location information to make a map available to the recipients of your messages showing your location. If you do not want this information collected by us, you can disable location services on your phone.

Aggregate Data. Voxer (and its contractors) may track, collect and report aggregate data regarding user activity, Products usage or Voxer Site usage (via analytics software or otherwise) and we may use this data for commercial purposes, but we shall not share any personally identifiable information except as expressly specified herein or in the Voxer License Agreement.

Device Data. Voxer (and its contractors) may collect and use technical data and information about Customer’s device and the system and application software incorporated on the device, to facilitate the provision of software updates, Product support and other services to Customer (if any) related to the Product. Voxer may use this information freely, including to improve its offerings or to provide services.

Site Activity Information; Device and Browser Information. We may keep track of and store in log files some of the activities you participate in while using the Voxer Site. In some cases you are also taking an action when you provide information or content to us. When you access t he Voxer Site from a computer, mobile phone, or other device, we may collect information from that device about your browser type, location and . Internet Protocol (IP) addresses, browser type, Internet Service Provider (ISP), pages visited, referring/exit pages, operating system, date/time stamp, and click stream data. We use this information to analyze trends, to administer the site, to track users’ movements around the site and to gather demographic information about our user base as a whole.

Click-through URL. In some of our email messages we use a “click-through URL” linked to content on the Voxer website. When customers click one of these URLs, they pass through our web server before arriving at the destination web page. We track this click-through data to help us determine interest in particular topics and measure the effectiveness of our customer communications.

Cookies and other technologies. As is standard practice on many websites, Voxer’s Site uses “cookies” and other technologies to help us understand which parts of our websites are the most popular, where our visitors are going, and how much time they spend there. We also use cookies and other technologies to make sure that our online advertising is effective. We use cookies and other technologies to study traffic patterns on our website, to make it even more rewarding as well as to study the effectiveness of our customer communications. And we use cookies to customize your experience and provide greater convenience each time you interact with us. If, however, you prefer not to enable cookies, certain features of the Voxer website will not be available to you.

Pixel Tags. In addition we use pixel tags — tiny graphic images — to tell us what parts of our website customers have visited or to measure the effectiveness of searches customers perform on our site. Pixel tags also enable us to send email messages in a format customers can read. And they tell us whether emails have been opened to ensure that we’re sending only messages that are of interest to our customers. We may use this information to reduce or eliminate messages sent to a customer. We store all of this information in a secure database maintained by us or our contractors.

c. Information We May Receive From Third Parties:

Information From Other Users. We may collect information about you from other Products users, such as when a friend provides friend details or contact information, or indicates a relationship with you.

Facebook. If you authorize the activity, Facebook may share with us certain approved data, which may include your profile information, your image, geographic location, and your list of friends, their profile information and their images.

6. How We Use and Share Information.

Sharing Your Name and Profile Picture. Voxer is designed to make it easy for you to find and connect and communicate with others. For this reason, your name and profile picture do not have privacy settings and other users of the Products will be able to see your name and profile picture once you register directly or through a third party. This data is freely shared.

Communications Content. Content you send to other users will show up on other user’s devices and these communications are also stored on our database. Even if you remove this content from your device or account, copies of this User Content will remain viewable on the devices of third party users with whom you have communicated and will be stored on our database for a period of time. Therefore you should be aware that User Content that you send to other users cannot be removed from their devices unless the other user removes the data. Also, other users can share any User Content you supply to them.

Providing our Services and Product Features. To the extent Voxer gains such access to Communications Content or to information that is identifiable information about the users of the Product or Voxer Site, Voxer agrees that it (and/or its contractors) will not share or use that information except: (i) to communicate with Customer (via email or via notification sent through the Product, or otherwise) regarding Product, features or services delivered by Voxer (including any support or maintenance that Voxer at it sole discretion provides to Customer) or in order to implement and deliver the features and services associated with the contemplated use of Product and Voxer Site, (ii) to deliver the features and functionality associated with Products and Voxer services; (iii) to diagnose problems and support our users and maintain and test and enhance the Product and Voxer Site (or related offerings), (iv) to monitor license compliance (v) to conduct other research and development activities, (vi) to assist our users in evaluating or testing the Products (vii) as permitted by Customer, (viii) as required by law or regulation.

Contacting You. Voxer may contact you from time to time to provide feedback about the Products or services or for service or product related announcements (via email, telephone, the support website or via electronic questionnaires). You may opt out of specific communication with the exception of essential updates by selecting the unsubscribe link on each email.

To Help Your Contacts Find You and to Help You to Add Contacts. We may allow other users to use contact information they have about you, such as your email address or your name, to determine if You are a Product user. If you are already a Product user, then others can add you to their contact list by choosing your name off of a list of users available via our products. We make your name available to others to help your Contacts find you.

Inviting Contacts. We also give you an opportunity to invite your Contacts to register at the Voxer Site and download the Products, and in connection with that activity you may provide us access to third party contact information. When you click to invite one or more friends to join Voxer an SMS invite is sent from you from your phone.To Provide You With Services or Product Functionality. We may provide information to service providers that help us bring you the services or product features we offer. For example, we may use third parties to help host our website, databases, send out emails, remove repetitive information, process payments, or other activities contemplated by our products and services. These service providers may have access to your personal information for these purposes, but when this occurs we implement reasonable contractual and technical protections to limit their use of that information to helping us provide the service.

To Respond to Legal Requests and Prevent Harm. We may disclose information pursuant to subpoenas, court orders, or other requests (including criminal and civil matters) if we have a good faith belief that the response is required by law. This may include respecting requests from jurisdictions outside of the United States where we have a good faith belief that the response is required by law under the local laws in that jurisdiction, apply to users from that jurisdiction, and are consistent with generally accepted international standards. We may also share information when we have a good faith belief it is necessary to prevent fraud or other illegal activity, to prevent imminent bodily harm, or to protect ourselves and you. This may include sharing information with other companies, lawyers, courts or other government entities.

Publicly Displayed Information is Public. If you use a bulletin board or chat room on our website or choose to share the content of your messages publicly from the application, you should be aware that any information you share is visible to other users. Personally identifiable information you submit to one of these forums can be read, collected, or used by other individuals to send you unsolicited messages. Voxer is not responsible for the personally identifiable information you choose to submit in these forums..

Sale or Merger of the Business or Portions of the Business; Business Transfers. If at some point Voxer sells all or a portion of its assets, or merges with another entity, or if Voxer goes out of business or enters bankruptcy, or re-organizes, the Voxer data (including user information collected) may be transferred to an affiliate or may be acquired by a third party in an asset sale or transfer. After such a transaction, the third party that becomes the custodian of the information/data purchased would have the right to continue using the information/data as set forth in this policy. You acknowledge that such transfers may occur, and that any acquirer may continue to use your information as set forth in this policy. Obviously, your information previously collected would remain subject to the promises made in any pre-existing Privacy Policy in place at the time the information was originally collected.

7. How We Protect Information.

Organizational and Technical Measures. Voxer takes certain organizational and technical measures to protect the access and usage of your personal and traffic data. Only Voxer authorized employees and contractors subject to obligations of confidentiality can access your personal data in order to fulfill their given duties.

Consent to Collection and Processing in the United States. By using the Products and Voxer Site, you consent to having your personal data transferred to and processed in the United States in the manner indicated in this Privacy Policy.

8. Deleting Your Account. Voxer Walkie Talkie may permit you to delete your account. If you choose to delete your account, your account profile information and your contacts data will be deleted from our servers. Once deleted, you will not be able to retrieve this information. Messages you have sent prior to deleting your account will remain accessible to the recipients and thus will remain on our servers.

9. Modifications to this Privacy Policy. Unless stated otherwise, our current privacy policy applies to all information that we have about you and your account. If we make changes to this Privacy Policy we will notify you and you understand that Voxer may update its privacy policy from time to time. When we change the policy in a material way a notice will be posted on our website along with the updated privacy policy. If such a change takes place, the revised Privacy Policy will be published at http://www.voxer.com/legal.
